JA Americas Privacy Statement 

JA Americas ("the organization" or "JAA") believes that everyone should know what data we collect, how we use it, and the control we exercise over it. JA Americas expects you to make informed decisions about the information you share with us. This Data Policy describes JA Americas' privacy practices regarding site.jaamericas.org (the "Site") user data and any data collection forms or information you share, as well as the services provided to those who participate in our initiatives.

What is JA Americas' legal basis for collecting and using your personal information? 

JA Americas will collect and use your personal information for the purposes set forth in this Privacy Statement. As explained below, the legal basis for processing personal information is (a) your consent; (b) the legitimate interest of JA Americas in carrying out its mission, including the growth and improvement of its educational services, provided that those interests are not outweighed by its rights and interests; (c) the performance of a contract with you; and (d) necessary to comply with a legal obligation.  

  

How does JA Americas collect your personal information?  

You provide information and JA Americas collects data in the normal course of its programs as follows:  

  • Information you provide to JA Americas: JA Americas collects personal information when you provide it directly to JA Americas, including when you subscribe to updates, newsletters, fill out contact forms, register for events, sign up to volunteer, donate, and register in the alumni community.  

  • Information JA Americas receives from third parties: JA Americas collects personal information provided by its partners, service providers, consultants, allies, schools and universities,   

  • Information that is automatically collected: JA Americas wants you to benefit from the information and services available on the Website. Like many websites, JA Americas uses web analytics tools that rely on cookies, and other automated tracking technologies to help JA Americas analyze how users interact with and use the site, improve the site, personalize your experience, provide you with information that may be of interest to you, and identify others like you who may be interested in our programs and services. How does JA Americas use your personal information? 

JA Américas collects and uses personal information only for the specific purposes explained in this Privacy Statement. These purposes include:  

  • To provide you with information through updates, newsletters and publications when you request them or when JA Americas believes they may be of interest to you. You will always have the opportunity to opt-out of receiving communications from JA Americas. JA Americas' legal basis for processing your personal information will be your consent. 

  • To provide you with information about programs and services, event information, volunteer opportunities, and employment opportunities with JA Americas, JA Americas members, Regional Operating Centers (ROCs), JA Americas alumni groups, and partners that you requested or that JA Americas believes may be of interest to you. You will have the opportunity to opt out of receiving communications from JA Americas. JA Americas' lawful basis for processing your personal information will be your consent where consent was obtained or JA Americas' legitimate interest in providing information about JA Americas, JA Americas members, ROCs, JA Americas alumni groups, and partners.  

  • Process donations through service providers. JA Americas' legal basis for processing your personal information will be your consent.  

  • Improve JA Americas' programs, services and operations. JA Americas' lawful basis for processing your personal information is that it is necessary for the purpose of a legitimate interest pursued by JA Americas, i.e., to improve its programs, services, and operations. JA Americas may also process your personal information to fulfill a contract.  

  • To research and analyze site user demographics, interests and behavior on an aggregate basis, including to improve our services and the JA Americas program experience for all participants, to measure the impact of participation in JA Americas programs and events and to communicate such impact metrics to donors and other stakeholders, to better understand and serve you and other users. To improve our website and its offerings. JA Americas' lawful basis for processing your personal information is that it is necessary for the purpose of a legitimate interest pursued by JA Americas, i.e., to improve the user experience of the site. Where applicable law requires consent to the use of certain cookies, we will ask for your consent.  

  • To obtain their comments and views through polls and surveys conducted by JA Americas and others. You are not required to respond to polls and surveys and may choose only the information you wish to provide. You will have the opportunity to opt out of receiving polls and surveys from JA Americas or others. JA Americas' legal basis for processing your personal information will be your consent.  

  • To comply with legal, safety, processing and regulatory requirements. JA Americas' legal basis for processing your personal information is that it is necessary in order to comply with a legal obligation and a legitimate interest pursued by JA Americas, namely to improve its programs, services and operations.   

How is your personal information shared?  

  •  Service Providers, Vendors and Consultants: JA Americas may share your personal information with our service providers, vendors and consultants in order to improve the Site and facilitate the services JA Americas provides on behalf of JA Americas. JA Américas may use service providers and consultants to perform promotional marketing, data analysis, credit card payment processing and provide customer service. These companies have access to personal information to perform their functions, but may not use it for other purposes. These include, for example, Squarespace (web platform), Google Analytics (website analytics), Salesforce (CRM service provider), Mailchimp (email marketing) and others. JA Américas will share your personal information when access to the personal information is necessary or useful to perform its services.  

  • Partners: JA Americas may share personal information with its partners to provide you with information that you have requested or that JA Americas believes may be of interest to you.  

  • JA Americas Members, Regional Operating Centers (ROCs), JA Americas Alumni Groups: JA Americas may share personal information with JA Americas Members, ROCs, and JA Americas Alumni Groups to provide you with information programs and services that you have requested or that JA Americas, JA Americas Members, ROCs, and JA Americas Alumni Groups believe may be of interest to you.  

  • Legal Obligation: JA Americas reserves the right to share your personal information when it believes such disclosure is necessary to comply with a legal requirement, such as a court order, valid discovery requests, valid subpoenas, or to protect the rights or property of JA Americas, you or third parties, and if JA Americas is acquired in a merger or acquisition. 

JA Americas does not rent or sell your personal information to third parties.  

  

What about children's programs and alumni program services?  

While we encourage children to participate, we ask that children under the age of 13 do so only with the supervision of parents, guardians and/or teachers. JA Americas does not knowingly collect personal information from anyone under the age of 13. If we learn that a child under the age of 13 has provided JA Americas with his or her personal information without verifiable parental consent, JA Americas will make every effort to delete this information from its files.  

  

What about sensitive data?  

JA Americas does not generally collect sensitive data (also known as special categories) through the site or otherwise. The term "sensitive data" refers to the various categories of personal data identified by data privacy laws as requiring special treatment, including in some circumstances the need to obtain your explicit consent. These categories include racial or ethnic origin, political opinions, religious, philosophical or other similar beliefs, trade union membership, physical or mental health, biometric or genetic data, sexual life or orientation, or criminal convictions and offenses (including information about suspected criminal activity).  

In the limited circumstances in which JA Americas may collect such data, JA Americas will do so in accordance with all applicable data privacy law requirements, which may include obtaining consent. If you choose to provide JA Américas with unsolicited sensitive data, you are consenting to JA Américas' use of the sensitive data, subject to applicable laws as described in this Privacy Statement.  

  

How does JA Americas protect your personal information?  

JA Americas understands that the security of your personal information is important. To that end, JA Americas maintains organizational, physical and technical security provisions for the personal information it collects to protect your personal information against accidental loss and against unauthorized access, use, alteration and disclosure.  

JA Americas restricts access to your personal information to those JA Americas employees who need to know that information to provide services to you. JA Americas trains these employees on the importance of confidentiality and maintaining the privacy and security of their information.    

However, despite our efforts, no security controls are 100% effective, and JA Americas cannot ensure or warrant the security of the personal information you provide to JA Americas. There is no guarantee that data cannot be accessed, disclosed, altered or destroyed through a breach of any of our physical, technical or administrative security measures.

This Privacy Statement applies only to information collected by this Site and JA Americas and not to other Web sites to which you may link from this Site.  

JA Americas uses SSL security on any form that requires credit or debit card information. JA Americas will never request information that can be used in a phishing scheme without SSL security behind the form.  

  

Where does JA Americas store your personal information and for how long?  

JA Americas stores your personal information on JA Americas' contracted cloud-based database management services servers located in the United States, Brazil, Mexico and Argentina.  

JA Americas will retain your personal information for as long as you allow JA Americas to retain your data, or as needed to provide you with information about JA Americas and its programs and services. What are your rights?  

You have the right to know what personal information JA Americas collects about you and to have access to that information. You may request access to your information by sending an email to info@jaamericas.org

In addition, you may opt out of receiving any communications from JA Americas about events or publications that JA Americas believes may be of interest to you. For example, you can subscribe to receive newsletters or e-mail notifications about particular events or services. You may opt-out of receiving these optional communications at any time by clicking on the "Unsubscribe" link in the footer of these emails.
